を採用し、法定の主題というためには、特定の機械又は装置と結びついたもの(it is tied to a paticular machine or apparatus)か、あるいは特定の物を別の状態又はものに変換するもの(it transforms a particular article into a different state or thing)でなければならないと判示した。1998年にState Street Bank事件でCAFC自身が示した&rdquo;useful, concrete and tangible result&rdquo; という基準だけでは不十分であるとも判示した。</div><div>　Bilski氏が出願したクレームは純粋なビジネス方法に属するもので、日本では明らかに「発明」でないとして拒絶される類のものである。State Street Bank事件のCAFC判決後、「米国では純粋なビジネス方法も特許になる」という風潮があったが、本判決はこれを完全に否定したといえる。そもそも、State Street Bank事件のCAFC判決を「ビジネス方法に特許性を認めた」と理解するのが誤りで、正確には、「ビジネス方法に関するものだという理由だけで特許性を否定するのは誤り」だとして、いわゆる「ビジネス方法の例外ルール」を否定したに過ぎない。</div><div>　日本では、ビジネス関連発明はソフトウエア関連発明の一種として取り扱われ、ソフトウエアによる情報処理がハードウエア資源を用いて具体的に実現されている場合は「発明」に該当するとされるが、本判決により米国と日本の保護対象は非常によく似たものになったと感じる。しかし、まだまだ &ldquo;machine-or-transformation test&rdquo;
